SMERTGuard Terms of Service

1. The service
SMERTGuard is a software subscription from smert.ai that uses computer vision to detect people, animals and selected events in zones you define, and to send alerts. It is provided for risk reduction only.
2. Safety disclaimer
SMERTGuard helps reduce risk; it does not remove it. It does not replace adult supervision, child locks, smoke detectors, medical alarms, security services or legal compliance obligations. It is not a certified safety, medical, security or HACCP certification device, and alerts can fail because of power, network, camera angle or lighting.
You remain fully responsible for the supervision and safety of children, elderly or vulnerable people, animals, staff, visitors and property. You must keep required safety devices installed (for example smoke detectors, child gates, socket covers, balcony protection, medical alarms) and follow all applicable laws.
3. No emergency service
SMERTGuard does not contact police, fire, ambulance or any monitoring centre. In an emergency, call your local emergency number.
4. Business use
SMERTGuard Business supports monitoring and record keeping. It is not a certification, legal compliance, HACCP certification, occupational safety inspection or security guarding service. Alerts about customer behaviour are indications only and must never be the sole basis for accusing or detaining any person. You are responsible for camera notices, staff consent and compliance with privacy law.
5. Subscriptions and trials
Plans renew automatically each month or year until cancelled. Home plans include a 7-day free trial; cancel before it ends to avoid being charged. Fair-use limits apply to phone calls and WhatsApp alerts.
6. Limitation of liability
To the maximum extent permitted by law, smert.ai is not liable for any injury, death, loss or damage arising from missed, late or false alerts, device, power or network failures, or the use of the service. Our total liability is limited to the subscription fees you paid in the 3 months before the claim.
7. Acceptance
You accept these terms when you create an account, and you confirm them each time you arm the system.
